This Terms and Service Agreement (“Agreement”, “TOS”) governs the use of web hosting, design and other services provided by SlopeHost LLC (“We,” “Our,” “Us,” “Company”) to the customer (“You,” “Your”, “Client”). By using our services, You agree to the terms and conditions set forth below.

1. Services Provided

SlopeHost LLC agrees to provide You with web hosting, design and other services, including but not limited to website hosting, website design and domain management.

2. Prohibited Content

SlopeHost will not design, host or assist with managing any of the following content:

• Adult Content: Any content that is sexually explicit, pornographic, or otherwise violates legal or ethical standards regarding obscenity.
• Hate Speech: Content that promotes hate, violence, discrimination, or intolerance based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected class.
• Illegal Content: Content that violates any applicable local, state, national, or international laws, including but not limited to fraud, theft, or harassmen
• Malicious or Harmful Content: Content that contains viruses, malware, ransomware, or other harmful software that could damage the operation of our hosting infrastructure or other users’ websites.

3. Cancellation and Termination

• Hosting Cancellation Request: After the design has been completed, you may cancel your monthly hosting services at any time by submitting a cancellation request via email to [email protected]. The email should include your account information (such as the account holder’s name, domain name, and reason for cancellation).
• Design Cancellation Request: After the design package and price has been decided on and the 50% deposit has been paid, you may cancel your design package, however no refund will be made for the deposit.
• Transfer of Domain Ownership: Upon cancellation, we will work with You to transfer ownership of your domain name to You or to another designated party. You will be responsible for any domain transfer or other associated fees, including any renewal charges. Domain name transfers are subject to ICANN restrictions (https://www.icann.org/resources/pages/faqs-2014-01-21-en). If You want SlopeHost LLC to continue managing your domain, a separate billing agreement can be negotiated.
• Website Files: If You wish to purchase your website files, we can negotiate the price of the files separately. Files are “as-is”.
• Refunds: We do not offer refunds for services already rendered unless otherwise specified in a special promotion or service agreement. You will be responsible for any outstanding payments or fees owed to the Company at the time of cancellation.

4. Payment and Billing

By signing up for our services, You agree to provide accurate payment information and to keep it up to date.

• 4.1 Monthly Hosting Fees: The recurring payment will be due on the 1st of each month, and considered late if not paid by the 15th of each month. At which time your website may be suspended until payment.
• 4.2 Design Package Fees: Upon Your approval of the design, the website will not be made publicly accessible until the remaining design package fee is paid in full.
• 4.3 Additional Services: Additional services will be paid as agreed upon in the SOW.

5. Limitation of Liability

We will not be held responsible for any loss, damage, or disruption caused by server outages, hacking, or other technical failures, except as required by law. Our liability is limited to the amount You have paid to us for services during the previous month.

6. Account Suspension and Termination

In addition to the cancellation provisions, we may suspend or terminate your website for violation of these Terms and Conditions, non-payment, or other actions we deem inappropriate. We will provide You with notice of the suspension or termination.

7. Modifications to the Agreement

We reserve the right to modify or update these Terms and Conditions at any time, with changes taking effect immediately upon posting on our website. It is your responsibility to review these Terms periodically to ensure compliance.
